Validity of the sales contract, goods and price information

Urbangardening Ltd (Registry code 12615959), located at Kunderi 34, Tallinn, Estonia, owner of the Web Store Urbangardening (hereinafter the Web Store).

Terms of sale are applicable from the Web Store when purchasing goods.

The prices of the products sold in the Web Store are mentioned at the products. An additional price will be charged for the delivery of the goods.

The cost of delivery depends on the location of the buyer and the way of delivery. The service fee is shown to the buyer upon completion of the order.

Information about the goods is provided in the Web Store directly at the merchandise.

Order completion

To order goods, you must add the desired products to the basket. To complete the order, fill in the required fields and select the appropriate delivery method. The amount of charge that can be paid through the bank link or other payment solution is then displayed on the screen.

The agreement will become valid as of the date of receipt of the payment to the Web Store bank account.

If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the purchaser will be informed as soon as possible and the money paid (including delivery costs) will be returned immediately, but not later than within 14 days after sending the notice.


Shipping

Goods will be shipped to following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Litchestain, Lithuania, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom.

The cost of shipping the goods is borne by the buyer and the corresponding price information is displayed next to the shipping method.

Goods shipped within Estonia generally reach the destination designated by the buyer within 2-10 business days from the entry into force of the contract of sale. In exceptional cases the Web Store has the right deliver the goods within 45 calendar days.

Goods shipped outside of Estonia usually take between 2 and 25 business days as of the sales contract’s entry into force. In exceptional cases the Web Store has the right deliver the goods within 45 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the electronic agreement within 14 days (depending on the products the buyer may not opt-out, the corresponding products and services must be listed in such cases and must comply with the conditions set forth in Estonian Law of Obligations Act (võlaõigusseadus) § 53 (4)).

The right of withdrawal does not apply if the buyer is a legal person.

In order to use the right of return for a 14 day period, the goods ordered can not be used in any way other than the necessary nature, characteristics and function of the goods in the manner permitted for testing the goods in the physical shop.

If the goods have been used for other purposes, than is necessary to confirm the proper function, nature, characteristics and operation of the goods, or if there is a sign of use or wear, then the Web Store has the right to refuse the refund and return of the goods.

In order to return the goods, you must submit an application for cancellation of the purchase of the goods, the form of which can be found here: withdrawal form and send it to the email address info@urbangardening.eu within 14 days after receipt of the goods.

The cost of returning the goods is borne by the buyer, unless the reason for the return is that the product to be returned is not in conformity with the order (for example, an incorrect or defective product).

The buyer must return the goods within 14 days following the submission of the application or provide proof that he has transported the goods to the carrier during the aforementioned period.

The Web Store will return the buyer immediately upon receipt of the returned goods, but no later than 14 days after the receipt of the cancellation application, all fees received from the buyer under the contract.

The Web Store may refuse to refund until the product has been returned or until the buyer has provided evidence that he has returned the product, whichever comes first.

If the buyer expressly opts for a different delivery method other than the most inexpensive delivery method offered by the Web Store, then the Web Store is not required reimburse the consumer the cost that exceeds the cost associated with the (offered) normal delivery method.

The Web Store has the right to withdraw from the sales contract and to recover the goods from the buyer if the price of the goods in the online store has been marked significantly below the market price of the goods due to error.

The right to file a complaint

The Web Store is responsible for the contractual terms of the goods sold to the buyer for non-compliance or defect that existed at the moment of transfer of the item, which occurs within a maximum of two years from the date of delivery of the goods to the purchaser. In the first six months from the transfer of the thing to the buyer it is presumed that the defect was already in place at the time of delivery. The rejection of this assumption is the responsibility of the Web Store.

The buyer has the right to contact the Web Store within two months as of the discovery of the defect of goods by sending an e-mail to info@urbangardening.eu or by calling +372 5918 1760.

The Web Store is not liable for any defects that have occurred after the delivery of the goods to the buyer.

The Web Store is not responsible for the defects of the goods caused by the postal service during transportation and / or postal service conditions.

If the merchandise purchased from the Web Store has defects for which the Web Store is responsible, the Web Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Web Store will return to the buyer all fees associated with the sales contract.

The Web Store complies with the complaint filed by the consumer in writing or in a format that can be reproduced in writing within 15 days.


Direct marketing and processing of personal data

The online store uses personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending goods to the buyer. The web store transmits personal information to the transport service companies in order to deliver the goods.

The web store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed an interest in entering the email address on the web site and has indicated his wish to receive direct mail notifications.

The buyer can at any time cancel the offers and newsletters sent to the e-mail by emailing us or by following the instructions in the e-mail.

Solving arguments

If the buyer has any complaints about the Web Store, please send an e-mail to info@urbangardening.eu. If the buyer and the Web store cannot resolve the dispute by agreement, the buyer can contact the Consumer Dispute Committee. The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and the Web Store. The buyer's appeal is reviewed by the Commission free of charge.
